Day-4: Five Days Certified Training Program on Mediation in collaboration with AIIMAS

Event brief description

The fourth day of 5 Days Certified Training Program on Mediation, organized by the School of Law, Galgotias University, in collaboration with AIIMAS, commenced on the welcome note by experts Ms. Anupam Dhingra and Ms. Tanya Madaan. Ms. Anupam Dhingra revisited the learning's from the last three days of program. She also briefly introduced the topics to be covered through-out the day. Ms. Tanya Madaan shared her lived experience with the participants on the do’s and don't s of mediator. 

In the first session, Ms. Anupam Dhingra asked participants to differentiate between conflict and dispute. Followed by an engaging discussion on Impasse, Types of Impasse, Techniques to overcome impasse and creative formulas like Aawaz-andaaz-alfaaz (as a form of communication) and Root to Route (for the impasse solution). Later on, the participants were given an hypothetical labour dispute problem - as a role play activity to understand the nuances of the impasse and the techniques of mediation through negotiation and bargaining. 

Event Detailed Description

The Five Days Certified Training Program on Mediation, organized by the School of Law, Galgotias University in collaboration with the All India Institute of Mediation and Arbitration Studies (AIIMAS), commenced with great enthusiasm and participation from students and faculty members. The program is designed as a 40-hour certified course to provide participants with theoretical understanding and practical exposure to the process and techniques of mediation as an alternative dispute resolution (ADR) mechanism.

Ms. Anupam Mittal ma’am elaborated on the significance of the communication techniques for a successful mediation. She shared her experiences as a mediator with the participants on the challenges of language barrier, substantive barrier, procedural barriers, emotional barriers and third party intervention during the mediation. She elaborated on the importance of neutrality, confidentiality, and communication in mediation practice. Her address was followed by Ms. Tanya Madaan, creative exercise on techniques of breaking the impasse through option generation and assessment strategy. The techniques of lateral thinking and brain storming were given as a role play activity to the participants. 

The academic sessions began with an introduction to the history and evolution of mediation, tracing its roots from ancient dispute resolution traditions to modern institutional frameworks. The second session delved into the nature of impasse and the techniques on overcoming the impasse. The training further explored the statutory framework governing mediation, and recent judicial developments.

The day concluded with felicitation by the Dean, School of Law to the experts from AIIMAS. Both sessions concluded with an interactive evening session providing a comprehensive understanding of mediation practice, setting the tone for the upcoming days of intensive training, role-plays, and skill-building exercises aimed at preparing participants to act as effective mediators in real-life disputes.

The Five Days Certified Training Program on Mediation successfully enhanced participants’ understanding of mediation as a vital tool for conflict resolution. Participants gained practical insights into communication, negotiation, and problem-solving through interactive discussions and case studies. The sessions equipped them with the ability to identify conflicts, manage emotions, and facilitate constructive dialogue between disputing parties. The program fostered a deeper appreciation of mediation’s role in reducing court burdens and promoting restorative justice. Participants left with enhanced confidence, ethical awareness, and transferable skills applicable not only in legal practice but also in professional and personal life situations.
