He emphasised that such programmes help enhance communication, deepen empathy, cultivate forgiveness, build confidence, and strengthen resilience.
The technical sessions began with Mr. K. K. Mukhija, who introduced Section 12A relating to pre-institution mediation and settlement, and discussed important amendments under the Commercial Courts Act, 2015. This was followed by Ms. Jaya Goyal, who delivered a comprehensive session on the Mediation Act, 2023. She explained the objectives and benefits of the Act and elaborated on mediation institutions, service providers, the mediation fund, mediation councils, agreements, appointment and termination of mediators, and the overall mediation process. She also touched upon the Mediation and Conciliation Rules.
The day concluded with a formal valedictory ceremony, where the proceedings of all five days were presented. Heartfelt gratitude was extended to the resource persons and AIIMAS patrons, Hon’ble Justice Rajendra Menon and Hon’ble Justice Sudhir Kumar Jain. The fifth and final day of the Specialised Mediation Training Programme at Galgotias University commenced with an inspiring address by Hon’ble Justice Rajendra Menon, who joined the session virtually. Justice Menon expressed his deep appreciation for the university’s pioneering initiative in introducing a structured 40-hour mediation training programme, recognising Galgotias University as the first institution to undertake such specialised faculty development.
He reflected on the long-standing hesitation within the legal profession—particularly among lawyers—to participate in formal training programmes. He emphasised that continuous learning is essential for strengthening both legal practice and legal education. Justice Menon underscored how training initiatives like this cultivate vital personal and professional attributes such as effective communication, empathy, forgiveness, confidence, and resilience, all of which are indispensable for educators, mediators, and legal practitioners.
Session 1: Pre-Institution Mediation & Amendments in Commercial Courts Law
The academic sessions began with an insightful lecture by Mr. K. K. Mukhija, who introduced participants to the concept of Pre-Institution Mediation under Section 12A. Tracing its evolution from the Commercial Courts Act, 2015, he explained how mandatory mediation before the institution of certain commercial suits helps reduce judicial backlog and encourages early, amicable conflict resolution.
Mr. Mukhija elaborated on the procedural stages of pre-institution mediation, the types of disputes it covers, and the key amendments that have strengthened this mechanism. He highlighted how this early intervention encourages parties to collaborate rather than litigate, reaffirming mediation as a crucial pillar in India’s commercial justice framework.
Session 2: The Mediation Act, 2023 — Detailed Overview by Ms. Jaya Goyal
The second major session, led by Ms. Jaya Goyal, offered a comprehensive exploration of the Mediation Act, 2023, India’s first standalone legislation dedicated entirely to mediation. She began by outlining the philosophy behind the Act, emphasising its goal to institutionalise mediation, enhance public confidence, streamline procedures, and expand access to dispute resolution.
Ms. Goyal provided detailed insights into the key components of the Act, including:
- The Mediation Fund
- Roles and functions of Mediation Institutions
- Responsibilities of Mediation Service Providers
- Regulatory oversight by the Mediation Council of India
She placed particular emphasis on the Mediation Agreement, explaining how parties enter into this agreement to appoint a mediator, define the scope of mediation, and establish procedural expectations. Her discussion covered critical aspects such as:
- Termination of the mediator, including conflict of interest, incapacity, or loss of confidence
- Termination of mediation, whether due to settlement, withdrawal by parties, or non-cooperation
- Mediation proceedings, from initial statements to negotiation and conclusion
- Confidentiality, ensuring that all disclosures and communications remain privileged
- Cost of mediation, including mediator fees and administrative expenses
- Online mediation, covering virtual sessions, electronic submissions, and data privacy safeguards
- Non-settlement reports, issued when parties do not reach an agreement while maintaining confidentiality
Her session effectively connected statutory provisions with practical realities, enabling participants to appreciate both the legal architecture and functional operations of mediation in India.
Valedictory Ceremony & Certificate Distribution
The programme culminated in a dignified Valedictory Ceremony. A consolidated report covering all sessions over the five days was presented, followed by expressions of gratitude to all resource persons and to the patrons of AIIMAS—Hon’ble Justice Rajendra Menon and Hon’ble Justice Sudhir Kumar Jain—for their unwavering support.
The ceremony was attended by the Vice-Chancellor, Registrar, senior academic leaders, and faculty members of the School of Law.
