The second session focused on bargaining and negotiation in mediation. Ms. Goyal explained the differences between positional, distributive, and integrative bargaining, emphasizing collaborative, win-win approaches. The importance of flexibility, creativity, and emotional awareness in negotiation was underlined. Two enriching sessions on Communication and Mediation Process were conducted by Ms. Jaya Goyal and Ms. Nagina Jain, focusing on the vital role of communication, listening, and negotiation skills in mediation practice. The training aimed to enhance participants’ interpersonal understanding and conflict resolution abilities through interactive learning, demonstrations, and roleplays.

Session 1: Communication in Mediation

The first session explored the essentials of effective communication, covering both verbal and non-verbal dimensions. Ms. Jaya Goyal discussed the importance of non-verbal communication—eye contact, posture, attentiveness, and empathy. Participants were encouraged to use clear language, avoid interruptions, and exhibit patience and warmth. Barriers to effective communication, such as emotional and physical distractions, were identified, and practical ways to minimize them were shared.

Ms. Nagina Jain emphasized verbal communication as the foundation of mediation. She outlined the benefits of clarity, immediate feedback, and trust building. Participants practiced skills like active listening, paraphrasing, summarizing, and neutral reframing, learning how these techniques help mediators understand parties’ perspectives and reframe conflicts in a constructive manner.
The S.O.L.E.R. model—Sit openly, Observe, lean forward, maintain Eye contact, and remain relaxed—was introduced to improve listening posture. Silence and empathy were discussed as powerful tools in understanding unspoken emotions. A roleplay activity enabled participants to apply these concepts and reflect on real mediation communication dynamics.

Session 2: Bargaining and Negotiation in Mediation

In the second session, Ms. Goyal delved into bargaining and negotiation techniques within the mediation framework. She explained three major forms of bargaining:

  • Positional Bargaining: Based on fixed legal or personal stands, often resulting in win-lose outcomes.
  • Distributive Bargaining: Focused on dividing limited resources, potentially competitive in nature.
  • Integrative Bargaining: Encourages creativity and collaboration for mutually beneficial, win-win settlements.

Participants examined how mediators can transform conflicts by focusing on interests rather than positions. Negotiation was presented as a complex interplay of human emotions, requiring flexibility, creativity, and active listening. Ms. Goyal emphasized that successful mediators guide parties through cooperation, emotional regulation, and balanced communication.

Roleplays during this session allowed participants to practice negotiation scenarios and reflect on effective strategies for reaching consensus while maintaining neutrality.
